How to show that Your Migraines are Completely Prostrating

Have you ever wondered how you could establish that your migraines are completely prostrating and occur more than once a month, thus qualifying you for a 50% rating under VA Code 8100?

Completely prostrating, as used in 38 CFR 4.124a, DC 8100, means extreme exhaustion or powerlessness with essentially total inability to engage in ordinary activities.  See VA Adjudication Manual, M21-1, Part V.iii.12.A.3.b.

Based on my experience representing clients in both VA and IDES cases, the most readily available evidence that can support your claim will come from both a headache journal and nonmedical evidence letters drafted by family members, coworkers, or classmates.  These letters can establish the completely prostrating nature of your headaches if it is clear that you are unable to perform any activities when these headaches occur and must simply lie down and rest or sleep.
