How to Use Witnesses Effectively- Part One

This week’s hearings drove home a critical lesson- when health care providers question the frequency and consistency with which clients display symptoms of orthopedic and neurological complaints, it is vital to have nonmedical evidence witnesses testify live or via speakerphone on these points.  Today I had a very salty prior enlisted “black shoe” testify in a sea services case regarding my client’s credibility, integrity and the consistency with which he was afflicted by flares of his injuries.   Game over- the board members were won over before my client even testified in his case.  Key tactical point- when using such witnesses, it is typically best for counsel to call them first so that they will set the stage for the board members to like, respect and have sympathy for your clients before they even testify.
